Dean Answers Questions About Pick Up Women At The Gym

George asks…

The childcare at my gym neglected my child…?

I attend a rather posh health club which is never particularly busy and always use the available child care. Yesterday, a near miss occurred involving my 22 month old son and their child care provider. Here are the facts:

My husband was called to change my son’s diaper approximately 45 minutes after signing him in. After changing my son, he placed him on the floor, washed his hands, and stopped to admire our 3 year old daughter’s painting. As he stood up to leave to return to his work out, he noticed that my son was no longer in the room and the door was propped open. He asked the care provider where our son was and she said she didn’t know. They (my husband and the lady) ran out of the room and were met in the hallway by a 12 year old girl saying a baby had just entered the elevator. They pushed the button and found my son inside safe and sound.

Please note that my husband had not indicated he was ready to pick up the kids nor had signed them out.

I spoke to the gym manager and told her that we would no longer be members unless we were assured that this woman was no longer a child care provider there. She seemed rather concerned, but said she would get back to me next week as she had to contact corporate lawyers/management before firing her. This sounds like baloney to me, but I am going to give her a week and not use the gym in the mean time.

My question is: what recourse can I take? I am not looking to sue, but I want to make sure that some type of agency is aware of this. Who licenses child care in gyms? I need some real advice, so please help me Yahoo Answers!

My husband did not leave the door open as I walked past and saw him in there with the kids minutes before it happened. The lady fully admitted to opening the door and using a prop. It’s not like my kid got a boo boo under her watch. Even as a teenaged babysitter (many years ago) I would have known better than to leave a door open unattended or without a barricade. A gate is located right next to the door for use in this situation. She willfully didn’t use it.

Dean answers:

Who left the door open your husband or the care provider. Can you prove it was the care provider and not someone else, review surveillance if available. No body’s perfect. It will be extremely difficult for the gym to fire the care provider. If I were them I would rather lose you as a customer than face a large wrongful dismissal lawsuit.

Alright, I agree that my reaction was solely based on fear and will not pursue it further. I will not allow her to care for my children any longer though, but she only works a couple days a week so it’s an easy fix. Before becoming a stay at home Mom I was a subject matter expert in captivity and have intimate knowledge of the details of exploited children. Your skin would crawl too and it happens faster than you would ever believe. Perverts sit outside of places like this waiting.

Dean answers:

She probably assumed that since your husband was dealing with the diaper change, that he was watching him (I know that’s what I’d think anyway). You’re blowing it out of proportion – just drawing it to the Director’s attention and making it a rule that the door should not be propped open is enough.
